Cultural heritage, violence and vaquejada

Abstract

Cultural exclusion is one of the most important aspects in contemporary times for industrial societies. The application of the principle of non-violence against animals cannot disregard aspects of intangible cultural heritage, nor can it imply the criminalization of people for the way of living. The prohibition of vaquejada is a subject whose complexity serves to demonstrate the understanding of the Cultural Constitution in contrast to the biocentric paradigm. Methodologically, using theoretical references from constitutional theory, as well as from the analysis of judicial decisions of the higher courts, the cultural environment of vaquejada is analyzed as a problem space for issues that precipitate the backlash resulting from the friction between the anthropocentric and biocentric paradigm. In conclusion, the article aims to demonstrate that the objective of human relations without violence does not exclude the consideration of intangible cultural heritage as a characteristic landmark of pacification, the criminalization of which creates a true aspect of the criminal law's selectivity against individuals in the process of struggle for recognition.

Fábio Wellington Ataíde Alves, Universidade Federal do Paraná, UFPR, Brasil

Professor efetivo do Departamento de Propedêutica e Processo, da UFRN, campus Natal, onde leciona as disciplinas de Criminologia e Justiça Restaurativa e a de Execução Penal. Autor do Livro "Colisão entre Poder Punitivo do Estado e Garantia Constitucional da Defesa" (Juruá, 2010), entre outras participações em obras coletivas. Doutorando pela UFPR (linha de pesquisa: Direito, Poder, Controle). Docência também na Escola Superior de Magistratura do Rio Grande do Norte e na Pós-Gradução da UNIRN. Graduação em Direito pela UFPB (1994), mestrado em Direito Constitucional pela UFRN (área de concentração: Constituição e Garantias de Direitos), especialização em Direito e Cidadania (UFRN). Juiz de Direito no Rio Grande do Norte desde 1996. Foi Juiz Auxiliar da Corregedoria Geral de Justiça (2017 a 2020) e da. Vice-Presidência do Tribunal de Justiça/RN (2021-2022). É juiz titular do 1o Juizado da Violência Doméstica de Natal/RN, coordenador estadual da Violência Doméstica (2023 - ) e dos Centros Expecializados de Atenção às Vítimas (2023- ).. Área de pesquisa: Criminologia, Não-violência, Justiça Restaurativa e Política Criminal. Exerceu outras docências e foi membro da Comissão de Ética da UFRN.
