Democracia e direitos humanos: democracia militante e a preservação do regime na jurisprudência do Tribunal de Estrasburgo

O presente trabalho tem por objetivo identificar os parâmetros estabelecidos pelo Sistema Europeu de Direitos Humanos para a proteção das democracias. Para tanto, serão analisados alguns julgados do Tribunal de Estrasburgo – doravante Tribunal Europeu de Direitos Humanos –, cujo objeto foi a verificação da compatibilidade da dissolução de partidos políticos por Cortes Constitucionais nacionais (órgãos de cúpula dos Poderes Judiciários nacionais) em relação aos direitos humanos, consoante previstos na Convenção Europeia de Direitos Humanos (“Convenção para a proteção dos Direitos do Homem e das liberdades fundamentais”), firmada no âmbito do Conselho da Europa. Por fim, o trabalho pretende demonstrar como tais elementos podem ser harmonizados com as diretrizes do Sistema Interamericano de Direitos Humanos e da ordem jurídica nacional.
