The role of the case method in brazilian legal education under the binding precedents system

This article addresses the relevance of legal education based on the case method within the current context where the Brazilian Judicial System emphasizes the authority of binding precedents from its Superior Courts. The study adopts a deductive approach, employing literature review and comparative research to support a proposal for restructuring the teaching materials in Brazil. After distinguishing the case method from the case study, the paper discusses the age of precedents currently experienced in Brazil. Based on this premise, the text explains the function of casebooks, which are used as a legal teaching tool via the case method in the United States, a system founded on precedents. It is then proposed to change the way law textbooks are presented to students in Brazil, aiming to align learning with the transformations in Brazilian Law since 2006, given the relevance of leading cases in establishing the legal theses that convey the correct interpretation of the law or the Constitution. It is concluded that the adoption of the case method and the reformulation of law textbooks would contribute to the training of law graduates by moving beyond the traditionally transmitted theoretical framework to incorporate reflection on practical and argumentative reasoning.
