Corporate management of public services and its impact on the democratic state and administrative law

The aim of this article is to analyze the impacts of corporate management of public services within the scope of the Democratic State and Administrative Law, especially with regard to public-private partnerships. To this end, by means of a descriptive study, with a qualitative approach, guided by the deductive method, through a data collection procedure based on a bibliographic survey, the advance of business management in public services will initially be addressed. It will then reflect on how the rise of neoliberalism may have influenced the privatization dynamics of public administration. Based on these premises, it will be examined whether, in terms of public services, the autonomization of public-private management, distanced from political, administrative and social control bodies, can affect the democratic management of these services, especially in the context of the legal-political structure of a social and democratic state. Finally, it will be presented how these transformations can impact concepts and principles concerning Administrative Law.
