Criminal review against an acquittal sentence with extra-penal effects
an exceptional case of applicability

This article, developed through applied and exploratory methods, analyzes the judgment rendered in the Criminal Review Case No. 1017566-42.2021.4.01.0000, which was processed before the Federal Regional Court of the 1st Region. In this case, the court admitted criminal review to change the legal basis of the acquittal from item III of Article 386 of the Code of Criminal Procedure (the act does not constitute a criminal offense) to that provided in item I of the same article (the nonexistence of the act is proven). The objective is to investigate the admissibility of criminal review outside the procedural and exhaustive hypotheses listed in Article 621 of the Code of Criminal Procedure, especially considering the extrapenal effects of the acquittal decree. It is concluded that an extensive interpretation of the institute, with the proposal of a new admissibility hypothesis for the autonomous challenge action in question, shows that the judiciary must go beyond the mere analysis of the legal classification to be guided by the prevalence of fundamental rights and guarantees, in order to ensure the implementation of justice in the specific case.
