Artificial intelligence represents one of the most important technological advancements for humanity; however, its development has not been accompanied by a regulatory framework that establishes the foundations for its design and evolution, which may lead to human rights violations by increasing vulnerability and reducing their effectiveness. Artificial intelligence advances at a pace that regulation can hardly keep up with, making it essential to establish legal foundations from a human rights perspective in order to prevent algorithmic biases that foster discrimination, inequality, and violence. We should not view artificial intelligence as an enemy to defeat, but rather as a tool that can become the best ally for those who know how to use and leverage it to enhance their capabilities. This article was developed through a qualitative documentary analysis grounded in a critical review of regulatory frameworks, scholarly literature, and recent cases concerning the development of artificial intelligence. This methodological approach enabled the identification of key risks, regulatory gaps, and ethical tensions affecting the protection of human rights, providing a structured interpretation of the current landscape and the challenges posed by algorithmic governance.
